JIMMIE VANCE GRUBBS FACING SIX ADDITIONAL
CRIMINAL COUNTS
Former School Teacher Charged in Six Additional Criminal Counts by
Federal Grand Jury
CHARLOTTE, NC - United States
Attorney Gretchen C.F. Shappert announced today the addition of six
more criminal counts to the existing indictment of Jimmie Vance Grubbs,
66, of Cornelius, NC. The superseding indictment was returned by a
federal grand jury sitting in Charlotte on Wednesday, April 26, 2006.
Grubbs is now facing three additional criminal counts alleging interstate
transportation of minors for the purpose of engaging in criminal sexual
activity, and three additional criminal counts alleging traveling interstate
with the intent to engage in illicit sexual conduct.
According to three of the new criminal counts appearing in the superseding indictment,
Grubbs is alleged to have knowingly transported a person under age 18 from North
Carolina to South Carolina with the intent that the individual engage in criminal
sexual activity. The dates alleged in these three new criminal counts fall within
2004, 2005, and 2006. The additional three new counts allege that Grubbs traveled
from North Carolina to South Carolina for the purpose of engaging in illicit
sexual conduct during 2004, 2005, and 2006.
Grubbs is currently in federal custody where he has remained since February 23,
2006, and will be arraigned on the new charges contained in today’s indictment.
The date and time of his arraignment has not yet been determined.
If convicted, Grubbs faces an additional mandatory minimum of five years’ imprisonment
and a maximum statutory penalty of 30 years’ imprisonment, a $250,000 fine,
or both, as to the three “transporation” counts announced today.
As to the three “traveling” counts announced today, Grubbs faces
a maximum statutory penalty of 30 years’ imprisonment, a $250,000 fine,
or both, as to each count. That increases the defendant’s maximum imprisonment
exposure to a total of 300 years. It is important to note, however, that any
sentence received upon conviction will be influenced by the Federal Sentencing
Guidelines, which the Court consults in order to determine each defendant’s
actual sentence. Sentences are based upon a formula that takes into account the
severity and characteristics of the offense and each defendant’s criminal
history, if any.
The charges contained in today’s superseding indictment are only allegations.
In the American justice system, a person is presumed innocent unless and until
he or she is proven guilty in a court of law.
The arrest of and continuing investigation regarding Jimmie Vance Grubbs is the
result of a joint investigation by the FBI and the Huntersville Police Department
with substantial assistance from the Myrtle Beach (South Carolina) Police Department
and the Forsyth County (North Carolina) Sheriff’s Office.
