JIMMIE VANCE GRUBBS INDICTED IN U.S.
DISTRICT COURT
Former School Teacher Charged in Four Criminal Counts
CHARLOTTE, NC - United States
Attorney Gretchen C.F. Shappert announced today the indictment of Jimmie
Vance Grubbs, 66, of Cornelius, NC, by a federal grand jury sitting
in Charlotte, on two counts alleging interstate transportation of minors
with intent to engage in criminal sexual activity and on two counts
alleging interstate travel with intent to engage in illicit sexual
conduct.
According to the indictment (copy attached), Grubbs is alleged in Count One to
have knowingly transported an individual who was at the time of the offense under
the age of 18 years, from North Carolina to Myrtle Beach, South Carolina, with
the intent that the individual engage in sexual activity for which any person
can be charged with a criminal offense. Count Two alleges that Grubbs knowingly
transported another individual who had not attained the age of 18 years from
North Carolina to Myrtle Beach, South Carolina, with the intent that the individual
engage in sexual activity for which any person can be charged with a criminal
offense. Counts Three and Four both allege that Grubbs knowingly traveled in
interstate commerce for the purpose of engaging in illicit sexual conduct with
a person under the age of 18.
Grubbs was served with a federal criminal complaint on February 23, 2006. The
federal criminal complaint remained sealed until today. Grubb appeared before
a United States Magistrate Judge in Charlotte on February 24, 2006 and was ordered
detained in federal custody at that time pending a detention hearing. Grubbs’ detention
hearing was scheduled for Wednesday, March 1, 2006; however, a federal magistrate
judge continued the detention hearing until sometime in the near future. Grubbs
currently is in federal custody and will be arraigned on the new charges contained
in today’s indictment. The date and time of his arraignment has not yet
been determined.
If convicted, Grubbs faces a maximum statutory penalty of not less than five
(5) years and not more than 30 years’ imprisonment and a $250,000 fine
on Counts One and Two and a maximum statutory penalty of 30 years’ imprisonment,
a $250,000 fine, or both, on counts Three and Four. It is important to note,
however, that any sentence received upon conviction will be influenced by the
Federal Sentencing Guidelines, which the Court consults in order to determine
each defendant’s actual sentence. Sentences are based upon a formula that
takes into account the severity and characteristics of the offense and each defendant’s
criminal history, if any.
The charges contained in the indictment are only allegations. In the American
justice system, a person is presumed innocent unless and until he or she is proven
guilty in a court of law.
The arrest of Jimmie Vance Grubbs is the result of a joint investigation by the
FBI and the Huntersville Police Department.
