JIMMIE VANCE GRUBB ARRESTED ON FEDERAL CHARGES

Former Mecklenburg County School Teacher in Federal Custody

CHARLOTTE, NC - Gretchen C.F. Shappert, U.S. Attorney for the Western District of North Carolina, announced today the arrest of Jimmie Vance Grubbs on Thursday, February 23, 2006 by Special Agents of the FBI on a federal criminal complaint filed under seal on the same day. Grubbs, of 11118 Aprilla Lane, Cornelius, North Carolina, in Mecklenburg County, was arrested on a federal criminal complaint which alleges that on or about July 30, 2004 and March 31, 2005 in Mecklenburg County, in the Western District of North Carolina, the defendant did knowingly transport an individual who has not attained the age of 18 years, in interstate or foreign commerce, with intent that the individual engage in prostitution, or in any sexual activity for which any person can be charged with a criminal offense, a violation of the federal transportation for illegal sexual activity laws (Title 18 USC, Section 2423(a) ).

Defendant Grubbs made his initial appearance before United States Magistrate Judge David C. Keesler in Charlotte today and was ordered detained in federal custody following his arrest and initial appearance on the federal criminal complaint. Grubbs will be afforded a detention hearing in U.S. District Court, which is currently set for *******. The defendant had been in custody of ** since he was taken in on ***. Grubb was released on bond by *** on ***[date]***.

The federal investigation, led by FBI with substantial assistance from the Huntersville Police Department, is ongoing.

Under the Federal Rules of Criminal Procedure, a defendant arrested on federal criminal complaint is entitled to a probable cause hearing within ten (10) days of his/her arrest, unless indicted or unless a criminal information against the defendant is filed in U.S. District Court before the passage of ten days.

DEFENDANTS ARE ENTITLED TO A PRESUMPTION OF INNOCENCE UNDER THE LAW, AND THE GOVERNMENT HAS THE BURDEN OF PROVING EVERY ELEMENT OF THE CHARGES BEYOND A REASONABLE DOUBT.

Neither the United States Attorney’s Office nor the Federal Bureau of Investigation will have further comment at this time.
